Terms of Service

These Terms of Service ("Terms") govern your use of the LumireCRM platform and any related services (collectively, the "Service") operated by LumireCRM ("we", "us"). By creating an account or accessing the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & account

You must be at least 18 years old and legally capable of entering into a contract. You are responsible for the accuracy of the information you provide and for keeping your credentials confidential. You must notify us promptly of any unauthorised access.

2. Acceptable use

You may not use the Service to send unlawful, infringing, or fraudulent content; to interfere with other users; to attempt to gain unauthorised access; to bypass security or rate limits; or to use the Service in violation of applicable laws (including sanctions, anti-money-laundering, and consumer-protection law).

3. Multi-tenant structure

LumireCRM is licensed by brokers and prop-trading firms (each, a "Tenant") who in turn provide services to their own customers ("end users"). If you signed up through a broker, your relationship with that broker is governed by their separate terms; we act solely as the platform operator and our liability to end users is limited to platform availability.

4. Fees

Paid subscriptions are billed according to the plan you selected. Fees are non-refundable except where required by law. We may change fees with at least 30 days' notice; continued use after the notice period constitutes acceptance.

5. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by LumireCRM or its licensors and is protected by intellectual-property law. You receive a limited, revocable, non-transferable licence to use the Service in accordance with these Terms.

6. Data & privacy

Our handling of personal data is described in our Privacy Policy, which is part of these Terms. You retain all rights to data you submit; you grant us a limited licence to process it solely to provide and improve the Service.

7. Service availability

We provide the Service on an "as-is" basis and use reasonable efforts to maintain availability. We do not warrant the Service will be uninterrupted or error-free. Scheduled maintenance and emergency changes may occur.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability under these Terms shall not exceed the fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

9. Termination

You may close your account at any time. We may suspend or terminate your access for material breach of these Terms, prolonged inactivity, or if required by law. On termination, your right to use the Service ceases; provisions which by their nature survive (IP, indemnity, liability, governing law) will continue.

10. Changes

We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect. The "Effective" date above reflects the current version.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which LumireCRM is incorporated, without regard to its conflict-of-laws provisions. Any dispute will be resolved in the courts of that jurisdiction.
